WAIVER AND RELEASE OF LIABILITY

READ CAREFULLY BEFORE SIGNING. THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS.
By signing electronically or manually, you agree to the terms below in accordance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and the Uniform Electronic Transactions Act (UETA).
1. Identification of Released Parties
This Waiver and Release of Liability is entered into in favor of:
National Shooting Horse Association, a Missouri corporation, including its affiliates and programs (including Flying 45), and its officers, directors, employees, volunteers, agents, clinicians, instructors, sponsors, landowners, event hosts, and partners (collectively referred to as “Released Parties”).
2. Acknowledgment and Assumption of Risk
I understand that participation in activities organized, sponsored, or affiliated with NaSHA involves inherent risks.
These activities may include, but are not limited to:
Equine activities
Riding and handling horses
Bovine-related activities
Firearm handling and discharge
Arena and outdoor activities
Travel to and from event sites
I acknowledge that risks include, but are not limited to:
Injury or death caused by unpredictable animal behavior
Falls, kicks, bites, collisions, or being thrown
Equipment failure or malfunction
Firearm discharge, misfire, ricochet, or proximity to firearm use
Hearing damage
Terrain conditions, footing changes, or environmental hazards
Acts or omissions of other participants
I understand that horses are powerful, unpredictable animals and that firearm use carries additional inherent risks.
I knowingly and voluntarily assume all risks, both known and unknown, even if arising from the negligence of the Released Parties, to the fullest extent permitted by law.
3. Missouri Statutory Warning
Under Missouri law, an equine activity sponsor or equine professional is not liable for injury to or death of a participant in equine activities resulting from the inherent risks of equine activities pursuant to Revised Statutes of Missouri Section 537.325.
4. Release and Waiver of Liability
I hereby release, waive, discharge, and covenant not to sue the Released Parties from any and all claims, demands, causes of action, damages, losses, or liability arising out of or related to my participation in NaSHA activities.
This release includes, but is not limited to, claims arising from the negligence of the Released Parties, to the fullest extent permitted by law.
5. Indemnification and Hold Harmless
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, demands, actions, or liabilities asserted by third parties arising from my conduct, actions, or participation in NaSHA activities.
6. Participant Responsibilities
I affirm that:
I am physically and mentally capable of participating in these activities.
My horse is fit and suitable for participation.
I will follow all safety instructions and event rules.
I am responsible for my own equipment and tack.
I carry my own medical and liability insurance coverage.
I understand that participation is voluntary.
7. Consent for Emergency Medical Treatment
In the event of injury or illness, I authorize the Released Parties to obtain medical treatment on my behalf.
I understand that I am financially responsible for all medical costs incurred.
8. Minor Participant Agreement (If Applicable)
If the participant is under 18 years of age:
I, the undersigned parent or legal guardian, acknowledge the risks described above and consent to the minor’s participation.
I agree to all terms of this Waiver on behalf of the minor and agree to indemnify and hold harmless the Released Parties from any claims arising from the minor’s participation.
9. Photo and Media Release
I grant permission for the Released Parties to use photographs or videos of me (or my minor child) taken during participation for promotional, educational, or marketing purposes in print or digital media without compensation.
10. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the State of Missouri.
11. Severability
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
12. Electronic Signature Agreement
By signing electronically or manually, I acknowledge that:
I have read and understood this entire document.
I understand that I am giving up substantial legal rights.
I sign this agreement voluntarily and without inducement.
PLEASE NOTE SEPARATE PARENT/GUARDIAN SIGNATURE FOR MINORS BELOW
